1. Overview

Growth Sites LLC, DBA LeadResurrect ("LeadResurrect", "we", "us", or "our") provides performance-based, AI-assisted database reactivation and speed-to-lead appointment setting services for businesses (the "Services"). Our Services may include strategy, setup, campaign creation, system integration, inbound lead response, outbound follow-up to prior inquiries, appointment booking workflows, reporting, and ongoing optimization.

By accessing or using our websites, forms, dashboards, integrations, or communication channels (including SMS, email, and voice), or by engaging us for Services, you agree to these Terms of Service (the "Terms").

If you do not agree to these Terms, do not use our Services.

2. Eligibility

You must be at least 18 years old and legally able to enter into binding contracts to use our Services. If you are using our Services on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.

3. Scope of Services

LeadResurrect’s Services are designed to help businesses respond to inbound inquiries quickly and re-engage prior leads through compliant, consent-based messaging. Depending on your plan or agreement, Services may include:

  • AI-assisted follow-up and appointment setting via SMS, email, and/or voice
  • Reactivation campaigns to prior inquiries, quote requests, and warm databases
  • Speed-to-lead workflows for new inbound leads
  • Setup and configuration of messaging systems, tracking, routing, and automation
  • Integration with your CRM and related tools (e.g., calendars, forms, call tracking, pipelines)
  • Performance reporting, campaign iteration, and optimization

Any timelines, deliverables, performance-based pricing, definitions of a “qualified appointment,” and payment terms may be further defined in an order form, statement of work, or separate client agreement, which will control if there is a conflict.

4. Acceptable Use

You agree to use LeadResurrect’s Services in a lawful, responsible manner. You will not:

  • Upload, transmit, or share any unlawful, harmful, deceptive, or abusive content.
  • Provide purchased, scraped, harvested, or rented contact lists without verifiable prior consent where required.
  • Misrepresent your identity, your business, your relationship to contacts, or the purpose of the outreach.
  • Use the Services to send spam, evade opt-outs, or bypass carrier/platform policies.
  • Attempt to disrupt or interfere with the operation of our platforms, websites, or communication systems.

We reserve the right to pause, suspend, or terminate access to the Services if we detect misuse, spam behavior, fraud, or non-compliant data sources, or if required by carriers, vendors, or applicable law.

5. Messaging & Communication Consent

Because LeadResurrect’s Services involve business communications, you understand and agree that outreach may occur via SMS, MMS, email, and/or voice depending on the campaign and your configuration.

5.1 Consent Standards

You (the client) are responsible for ensuring that contacts you provide or authorize for outreach were collected lawfully and with the required consent for the type of messages being sent. This includes consent required under applicable laws and carrier policies (including, where applicable, TCPA, CTIA guidelines, CAN-SPAM, and similar local equivalents).

5.2 Outreach Purposes

Our communications (or communications sent on your behalf) may relate to:

  • Following up on prior inquiries, quote requests, or service interest
  • Responding to new inbound leads quickly (“speed to lead”)
  • Scheduling, confirming, rescheduling, or reminding about appointments
  • Providing service-related updates, intake questions, or next steps
  • Sharing requested information about offers, pricing, or availability

5.3 SMS Disclosure

  • You or your contacts may receive automated text messages sent by LeadResurrect or our service providers on your behalf.
  • Message frequency varies based on active campaigns, lead volume, and interactions.
  • Message and data rates may apply.
  • Opt-out is available by replying STOP. For help, reply HELP.

Consent to receive messages is not a condition of purchasing goods or services, unless otherwise permitted by law and clearly disclosed.

6. Client Responsibilities

If you engage LeadResurrect to contact your leads, prospects, customers, or list(s), you are solely responsible for:

  • The accuracy, provenance, and lawful collection of all contact information you provide or authorize.
  • Maintaining records of consent where required and honoring opt-outs promptly.
  • Ensuring your business practices, offers, and representations are lawful and not misleading.
  • Reviewing and approving any messaging, scripts, offers, or campaign parameters used on your behalf.
  • Providing timely access to required systems (CRM, calendars, tracking, etc.) and responding to operational questions.

LeadResurrect provides implementation and operational services but does not provide legal advice. You should consult your own legal/compliance advisors as needed.

7. Data & Privacy

We handle personal data in accordance with our Privacy Policy, which forms part of these Terms. The Privacy Policy describes what information we collect, how we use it, and how we protect it.

We do not sell personal data to third parties. We may share data with trusted service providers (such as messaging platforms, CRM/integration providers, analytics providers, and infrastructure vendors) solely to deliver, maintain, and improve our Services.

8. Service Availability & Third-Party Dependencies

We strive to provide reliable, high-quality Services, but we do not guarantee uninterrupted availability. Service interruptions or delivery issues may result from:

  • Carrier filtering, throughput limits, or network issues
  • Platform maintenance or updates
  • Third-party service disruptions (CRM, calendaring, messaging, etc.)
  • Account restrictions or policy enforcement by carriers or vendors
  • Events beyond our reasonable control

We may modify, suspend, or discontinue parts of the Services at any time, with or without notice, where permitted by law.

9. No Guaranteed Outcomes

LeadResurrect’s Services are designed to improve follow-up, responsiveness, and conversion opportunities. However, outcomes vary based on your industry, offer, pricing, market conditions, lead quality, sales process, availability, and many other factors.

  • We do not guarantee specific revenue, profit, conversion rates, or number of booked appointments.
  • We are not responsible for your team’s ability to close, fulfill, or service booked opportunities.
  • Any examples, projections, or past results are illustrative and not promises of future performance.

10. Fees, Payments, and Performance-Based Terms

Fees may include setup fees, monthly service fees, usage fees (e.g., messaging/telephony), and/or performance-based fees, as specified in your order form, statement of work, or client agreement. You agree to pay all fees when due.

If your plan includes performance-based pricing, the definition of a billable event (such as a qualified appointment), dispute windows, and reporting method will be governed by the controlling client agreement.

11. Limitation of Liability

To the fullest extent permitted by law:

  • LeadResurrect is not liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Services.
  • Our total aggregate liability for any claim related to the Services will not exceed the amounts paid by you for the Services in the thirty (30) days prior to the event giving rise to the claim.
  • LeadResurrect is not responsible for carrier filtering decisions, vendor enforcement actions, or delivery issues caused by third-party platforms outside our control.

12. Termination

We may suspend or terminate your access to the Services if you:

  • Violate these Terms or any applicable policies
  • Engage in fraudulent, abusive, or unlawful activity
  • Use non-compliant or unauthorized contact lists
  • Fail to pay fees owed for Services (where applicable)
  • Trigger carrier/vendor enforcement actions due to content, consent, or sending behavior

You may stop using the Services at any time. Any provisions that by their nature should survive termination (including limitation of liability and dispute provisions) will continue to apply.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated Terms on our website with a revised "Last Updated" date. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
